§1 Organiser

The organiser of the 2024 Seed Advent Calendar Competition is Magic Garden Seeds GmbH, Junkersstraße 7, 93055 Regensburg, hereafter referred to as “the Organiser.” The Organiser’s website can be found at http://www.magicgardenseeds.de.

§2 Participation in the Competition

2.1 To enter the competition, participants must submit a product review on the Organiser’s website, which requires registration on the website. To register, all requested personal details—full name, company name (if applicable), address, email address (collectively referred to as “Data”)—must be provided. Incomplete or inaccurate registration forms will not be considered.

2.2 Participation and chances of winning do not depend in any way on the purchase of goods or the use of any paid or free services from the Organiser or any companies involved in the competition’s execution.

2.3 Cash payment of the prizes is excluded.

2.4 Persons under the age of 18 or whose permanent residence is outside Germany, Austria, or Switzerland are not eligible to participate. Legal representatives and employees of the Organiser are also ineligible.

§3 Exclusion from Participation

The Organiser reserves the right to exclude participants from the competition without notice if they manipulate or attempt to manipulate the competition or its participation process, or if they breach the participation rules. Specifically, the following manipulations may result in exclusion:

- submitting multiple reviews using different email addresses,
- registering via a service provider primarily involved in competition manipulation,
- submitting a review that is unsuitable for publication, e.g., due to legal violations under German law.

§4 Termination of the Competition

The Organiser reserves the right to terminate the competition in whole or in part (for certain prizes or special draws). This applies particularly if the competition cannot proceed as planned due to, for example, computer viruses, software and/or hardware errors, or other technical and/or legal reasons, including manipulations or attempts to manipulate that impact the management, security, integrity, or orderly conduct of the competition.

§5 Start and End of the Competition; Date of Prize Draw

The competition begins on 9 November 2024 and ends on 28 November 2024. The prize draw will take place on 29 November 2024, after which the winners will be contacted, and prizes will be dispatched.

§6 Determination of Winners

Winners will be selected by a random draw from all participants. No selection is made by the Organiser.

§7 Description of Prizes

The following prizes will be drawn among participants: three Seed Advent Calendars featuring vegetable, herb, and flower seeds.

§8 Data Processing

Magic Garden Seeds GmbH collects and stores the Data on a server. The Organiser uses this data to contact participants in the event of a prize win.

§9 Data Deletion

There is no automated deletion of your review or customer account.  
Your rights under §9 remain unaffected.

§10 Privacy Protection

The Organiser is committed to protecting participants’ privacy and assures compliance with the Federal Data Protection Act, the Telemedia Act, and the European Data Protection Directive (95/46/EC).

§11 Data Protection

Participants may withdraw their consent to data processing at any time. They also have the rights to information and rectification of collected data as granted by the Federal Data Protection Act.

§12 Consent

By participating, I accept the terms and conditions of participation and confirm that I am at least 18 years old. If I do not accept the terms, I will be ineligible to participate in the competition or the prize draw. I may withdraw my consent at any time; doing so will disqualify me from further participation.

§13 Applicable Law

All legal relationships arising from or related to these terms and conditions and the data protection notice are exclusively subject to the laws of the Federal Republic of Germany.
